Can I withdraw from the contract?

The right of withdrawal or "rethinking" consists of the possibility granted to consumer, to unilaterally decide to dissolve the contractual bond with the seller by returning the purchased goods (or revoking the order placed) and consequently obtaining the return of the price paid in accordance with the new NEW EUROPEAN DIRECTIVE 2011/83 / EU which aims to better protect online purchases.

The new legislation:

  • it applies only to the consumer who acts as a natural person (therefore those who purchase goods and services with VAT number or in any case as professionals or companies are excluded),

  • it does not concern the supply of goods that risk deteriorating or expiring rapidly, the supply of sealed goods that are not suitable for return for reasons of hygiene or related to health protection and have been opened after delivery,

  • it does not apply for customized goods,

  • it does not apply if the price of the goods or service is linked to fluctuations in uncontrollable financial market rates.

How much time does the consumer have to withdraw from the contract?

The time available to exercise the right of withdrawal in the case of distance selling is 14 days.

The customer will also receive a refund of the amount paid within the following 14 days, with the same payment instrument used to purchase the good.

How can I withdraw from the contract?

In case of withdrawal, do I have to pay the shipping costs?

The shipping costs for the return of the goods are charged to Olio e Conserve Martino if there is the desire to return the goods.

The shipping costs for returning the goods are charged to Olio e Conserve Martino for defects in goods or shipping.

Refunds will be made using the same payment method used for the initial transaction, unless expressly agreed otherwise; in any case, there are no further costs for the refund

If the customer has chosen a non-standard shipping method (fast delivery, insured shipping, delivery to the floor, etc.), Olio e Conserve Martino undertakes to return only the amount equal to the type of standard delivery.

Am I entitled to withdrawal even if I have opened the package?

The goods must be returned in a "normal state of conservation": it can be manipulated to verify its nature, characteristics and functioning without causing damage or a decrease in value. Otherwise, the consumer is entitled to receive a refund of the current value of the goods only.
